Close, but you should be using an IF statement for this kind of test.
IF(
[Departure Date]<=Today() and [Return Date]>=Today(), "ACTIVE",
[Departure Date]<Today() and [Return Date]<Today(), "PENDING",
[Return Date]<Today(), "INACTIVE")
